25 / 06 / 10 - Upcoming new regulations for tax return preparers

The IRS has proposed new regulations with respect to registration, testing and continuing education of paid tax return preparers. The proposed regulations under section 6109 published in the Federal Register on March 26, 2010 contain the following upcoming requirements:

  • All paid tax return preparers are required to sign-up with the IRS, pay a registration fee, and obtain a preparer tax identification number (PTIN). Even if the preparer has already a PTIN, he is still required to sign-up under the new process.
  • All paid return preparers are required to pass a competency test. Attorneys, certified public accountants (CPAs) and enrolled agents who are active and in good standing with their respective licensing agencies are except from the competency test.
  • All paid preparers are required to continue professional education of 15 hours per year except attorneys, CPAs and enrolled agents.

The new system for registration will be available in approximately September 2010. For the moment it is not determined who will perform the competency test (IRS or external vendor) and how the test will be structured.
